1. Who we are

FiveHost is operated as a sole trader by Ross Attfield, trading as FiveHost, with a principal place of business at Hatherleigh, Snatchwood Road, Abersychan, Pontypool, NP4 7BS, Wales, United Kingdom. References to "we", "us" or "our" in these terms refer to FiveHost.

2. The service

FiveHost provides managed Kuzzle backend hosting instances for FiveM roleplay servers ("the Service"). Each subscription includes:

• One managed Kuzzle instance hosted on shared infrastructure
• Production and development indexes
• Daily automated backups
• HTTPS-encrypted API endpoint
• Access to support via Discord

The Service is provided on a fair-use basis. We reserve the right to contact customers whose usage significantly exceeds normal patterns before taking any further action.

3. Subscriptions and billing

Subscriptions are billed monthly in advance via Stripe. By subscribing you authorise us to charge your payment method on a recurring monthly basis until you cancel.

Prices are displayed inclusive of any applicable taxes. We reserve the right to change pricing with 30 days' written notice to existing subscribers.

4. Cancellation and refunds

You may cancel your subscription at any time from your Stripe billing portal. Your instance will remain active until the end of your current billing period. We do not provide refunds for partial months.

Upon cancellation your data will be retained for 7 days, during which you may request an export. After 7 days your instance, indexes, and all associated data will be permanently deleted.

5. Acceptable use

You agree not to use the Service to:

• Store or process illegal content of any kind
• Attempt to access other customers' data or indexes
• Conduct denial-of-service attacks or attempt to overwhelm shared infrastructure
• Resell or sublicense access to the Service without our written permission
• Store personally identifiable information beyond what is necessary for your FiveM server's operation

We reserve the right to suspend or terminate accounts in breach of these terms immediately and without notice.

6. Uptime and availability

We aim to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. Planned maintenance will be announced in our Discord server where possible. We are not liable for losses arising from service interruptions.

7. Data and backups

We take daily automated backups of all customer data for disaster recovery purposes. While we take reasonable steps to protect your data, you are responsible for maintaining your own backups of critical data. We are not liable for data loss.

8. Limitation of liability

To the fullest extent permitted by law, FiveHost's total liability to you for any claim arising from the Service shall not exceed the total amount paid by you in the 3 months preceding the claim. We are not liable for indirect, consequential, or incidental losses including loss of revenue, data, or goodwill.

9. Intellectual property

All data you store in your Kuzzle instance remains your property. We claim no ownership over your data. You grant us a limited licence to store and process your data solely for the purpose of providing the Service.

10. Changes to these terms

We may update these terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
